These Terms and Conditions ("Terms") govern your use of the website www.cater.com.kw and any catering services provided by Let's Cater Company, Commission Agent and Commission Agency ("we", "us", or "our"). By using our website or booking our services, you agree to these Terms.
1. About Us
Let's Cater Company, Commission Agent and Commission Agency is a catering business registered in the State of Kuwait, with its registered address at Block 1, Street 4, Building 17, Qurtoba 73501.
2. Services
We provide catering services for weddings, corporate events, private celebrations, and similar occasions. The specific menu, pricing, headcount, equipment, staffing, and delivery details for your event will be set out in a quotation or booking confirmation issued to you.
3. Bookings, Quotations and Confirmation
- Quotations are valid for 14 days from the date of issue unless stated otherwise.
- A booking is confirmed only once you have accepted the quotation in writing and paid the required deposit.
- Final guest numbers and menu choices must be confirmed no later than seven (7) days before the event date. We will make reasonable efforts to accommodate later changes but cannot guarantee them.
4. Pricing and Payment
- All prices are quoted in Kuwaiti Dinars (KWD) unless stated otherwise and are inclusive of applicable taxes where required by law.
- A non-refundable deposit of 25% of the total event value is required to confirm a booking.
- The remaining balance is due no later than seven (7) days before the event, unless other terms are agreed in writing.
- Late payment may result in cancellation of the booking and forfeiture of the deposit.
5. Cancellations and Refunds
If you need to cancel a confirmed booking, the following terms apply:
- More than 30 days before the event: deposit is non-refundable; any additional payments will be refunded.
- Between 15 and 30 days before the event: 50% of the total event value is payable.
- 14 days or fewer before the event: 100% of the total event value is payable.
If we cancel a booking due to circumstances within our control, you will receive a full refund of all amounts paid. We are not liable for cancellations caused by force majeure events (see Section 11).
6. Client Responsibilities
- Provide accurate event details, including date, venue, guest count, and access information.
- Ensure suitable space, power, water, and waste-disposal facilities at the venue, unless we have agreed otherwise.
- Obtain any required permits, licenses, or venue approvals for the event.
- Behave respectfully toward our staff and pay for any damage caused to our equipment by your guests.
7. Food Allergies and Dietary Requirements
You must inform us of any allergies, intolerances, or special dietary requirements in writing at least seven (7) days before the event. While we take reasonable care in food preparation, our kitchens handle nuts, dairy, gluten, seafood, and other allergens, and we cannot guarantee a fully allergen-free environment.
8. Equipment and Property
Any equipment, crockery, linen, or other items we provide remain our property. You are responsible for their safekeeping during the event and will be invoiced for replacement at full retail value for any items damaged or not returned.
9. Photography and Marketing
Unless you notify us otherwise in writing, we may take photographs of food, setups, and the general event environment (not focused on identifiable guests) for use in our portfolio, website, and social media.
10. Intellectual Property
All content on www.cater.com.kw — including text, images, logos, and design — is owned by or licensed to Let's Cater Company and is protected by intellectual property laws. You may not reproduce, distribute, or use this content commercially without our prior written consent.
11. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, government action, civil unrest, pandemics, supply-chain disruption, or utility failures. Where reasonably possible, we will reschedule the event.
12. Limitation of Liability
To the maximum extent permitted by Kuwaiti law, our total liability arising from any booking is limited to the amount you have paid for the event in question. We are not liable for indirect, consequential, or incidental losses, including loss of profit, business, or goodwill.
13. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your breach of these Terms or any unlawful conduct in connection with your event.
14. Privacy
Your use of our website and services is also governed by our Privacy Policy, which explains how we collect and use personal information.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above shows when they were most recently revised. The version in effect at the time of your booking applies to that event.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Kuwait. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.
